The policies below constitute the standard terms and conditions of Flexis Systems Pty Ltd in the distribution of ChordWizard products.

Privacy Policy

To protect your right to privacy, we have developed this Privacy Policy.  This policy applies to customers and other individuals who provide Flexis Systems Pty Ltd with their personal information.

Our Privacy Policy explains:

• Your right of access to your personal information
• Your right to inspect and correct the personal information that we hold about you
• Your right to have your privacy complaints investigated and resolved
• Your right to have your personal information protected from misuse or unauthorised access

What is 'personal information'?

Personal information is any information that can be used to identify a person no matter how it is collected or recorded.

What personal information do we collect and use?

Flexis Systems Pty Ltd is a private company registered in Australia.  We develop and distribute music software through our web site at https://www.chordwizard.com.

In the course of providing sales and support of our software products and any related services, we may need to collect personal information from you.

Should we collect personal information from you this may include your name, current address, email address, telephone numbers, credit card details and other means of personal identification.

We will not use your personal information for any purpose which is not related to the product or service we provide to you or for any purpose for which you would not reasonably expect us to use your personal information.

Your personal information may also be used:

• to provide you with information about our products and services on request
• for administration purposes, including charging, billing and collecting debts
• to promote other ChordWizard products and services which may be of interest

If you send us comments on our products, extracts may be displayed for promotional purposes on our websites, together with your first initial and surname. If you object to this, please inform us and your comment will be removed immediately.

We will take all reasonable steps to ensure that the personal information that we hold is accurate and up-to-date.  If you feel that information about you is not accurate or your details have or are about to change, please inform us and we will correct or update your personal information.

If you would like to access any of our services on an anonymous basis please tell us.  If this is possible and lawful, we will take all reasonable steps to comply with your request.  However, if you choose not to provide us with your personal information we may not be able to provide you with the services you require.

What happens if you choose not to provide your personal information?

You are not obliged to give us your personal information.  However, if you choose not to provide us with personal details, such as your name or address, the range of services available may be limited.

For example, we cannot make sales, or verify that you are a licensed user of our products for support purposes, without the appropriate details.

How do we collect personal information?

Where possible, we collect your personal information directly from you via telephone, electronic or paper forms.  If you feel that the information that we are requesting is not information that you wish to provide, please feel free to raise this with us.

When do we disclose your personal information?

We guarantee that we will not sell your personal information to any third party.  Your details will only be disclosed to other parties in the following circumstances:

• When you have requested a service or product which requires the third party to be involved.  For example if we arrange for a reseller to order in one of our products on your behalf, your name and phone number may be provided to the reseller so you can be contacted when it arrives.
• When we are required to by the law, banking processes and obligations, or by our own reasonable and responsible business practices.  For example, processing payments, cooperation with credit card fraud investigations, or debt recovery.

In all cases, we will provide the minimum necessary information to third parties, to protect your privacy to the greatest possible extent.

Access to your personal information

You have a right to access your personal information, subject to certain exceptions provided for in the Privacy Act.

If you require access to your personal information, please contact our Privacy Officer.  For security reasons, you will be required to put your request in writing and provide proof of your identity.

We will take all reasonable steps to secure your personal information.  Electronic information is protected by various security measures and access to information and databases is restricted, by password protection and physical security measures.

Returns Policy

To clarify your rights as a customer, we have developed this Returns Policy.  This policy applies to customers who have purchased products or services directly from Flexis Systems Pty Ltd.

If you have purchased a ChordWizard product from a reseller, you will need to pursue your claim with the reseller.

Our Returns Policy explains:

• Our general approach to exchanges and refunds on purchases made with us
• Circumstances where refunds or exchanges are available
• Your responsibilities when claiming a refund or exchange

General returns policy

Please choose carefully before purchasing, as we do not normally exchange or give refunds if you simply change your mind or make a wrong decision.

In some cases there are upgrade offers available which will allow you to transfer your license to an alternative ChordWizard product, at a reduced upgrade price.

All ChordWizard products are available in a free downloadable trial edition, giving you the opportunity to evaluate the product thoroughly before your purchase.

In general, you are responsible for ensuring the suitability of a product to your needs, unless we have provided misleading information which you used as the basis for your purchase decision.

When refunds are available

Refunds are available on software licenses and products sold by us directly to you, under the following circumstances:

• A product is faulty, and we have not been able to resolve the problem with you
• A product has been wrongly described to you by us or our promotional material
• A product differs from a sample that we have made available to you

You will need to provide sufficient details for us to verify that you are a licensed user of the product in question.  If you have purchased the CD-ROM media for the product from us, this will need to be returned to us before your refund can be completed.

You may also need to verify in writing that the product has been removed from your computer, and that you have not made, or permitted anyone else to make, copies whether electronic or otherwise, of the product or of any copyright material associated with the product.
